That Cute Little Baby in the Arms of His Loving Mother, Is an American Citizen. No Question About It
In the same week, as the 250th birthday of the United States of America, is as fine a time as any to take a moment out, not only to celebrate the 250th year of the republic, but to exhale, as the highest court in the land did not waver in its duty to preserve the concept of birthright citizenship despite the ill intentions of the worst, most incompetent and traitorous individual ever to be elected to the presidency.
The 14th Amendment of the Constitution of the United States of America guarantees equal protection under the law, and due process before any individual can be deprived of life, liberty and property. Also, “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”
Forgetting the legal jargon for a moment, the amendment put a kabash to the horrific Dred Scott decision of 1857. A horrendous adjudication which had deprived enslaved people of citizenship and other constitutional protections. The Dred Scott decision has subsequently, been firmly established by constitutional scholars and lay persons alike, as an abomination, and a tremendous mistake that was correctly tossed aside into the great dustbin of history.
Chief Justice of the Supreme Court, at the time, the infamous and bigoted, Roger B. Taney is surely burning in hell right now. If not, he deserves to be.
In the decades since the 14th Amendment was ratified by the states, a process formally concluded in July of 1868, the protections of the clause has been regarded as not only applying to freed slaves, but to “all persons.” - It can be any clearer than that.
There aren’t any time limits or restrictions in the amendment, thus “all persons born or naturalized in the United States” are to be considered as citizens.
This is where Trumpy comes in.
The Make America Great Again movement is a cult and President Donald J. Trump is the leader of that cult. And in Trump’s, now almost six full years combined, in the presidency, MAGA seems to be solidly coded as “white persons only.”
The White House under Trumpy has attacked DEI policies in the federal government, and in private businesses that receive funding from the government, thus placing some of the nation’s most prestigious colleges and universities under both scrutiny and sanction.
Museums have been instructed to remove artifacts and deprioritize exhibits the display of exhibits that show the worst of the Jim Crow era and of slavery, itself.
All of this less, little Bobby Blonde Hair from Never Been There Before, Kentucky be made to feel sad and anxious because his ancestors did horrible things to enslaved Black people.
Pete Hegseth, the United States Secretary of Defense, seems to relish denying promotions to people of color, and to women. In addition to that outrage, the Trump White House, this time around, doesn’t seem to have any actual Black people in high profile cabinet positions.
Tim Scott, the notably, always smiling Black – we won’t even say it – Senator from the State of South Carolina, did everything but polish old man Trumpy’s shoes, and he still didn’t get nothing!
The Director of the Federal Bureau of Investigation of the United States, Kash Petal is an Indian, and a rather dark-complexioned one at that, so he’s an exception to what seems to be an administration that is steeped in the values of white supremacy.
What else is one to think? Actual evidence is the best evidence. Or are you going to believe Trumpy’s lies about Making America Great Again? Thus, did it really come as a surprise when Donald started chirping about doing away with this whole “oh no you don’t” birthright citizenship nonsense.
The noise and the anger in the higher ranks of the MAGA cult is intense, about all these dirty, undeserving foreign women from black, brown and yellow countries coming to America to give birth to babies that are not of European descent. The darkening of the population quickly takes on a more sinister meaning from a white supremacist’s point of view.
The untouchable racial hierarchy of America is at risk. An established norm that has the white majority population on top.
If current trends continue as to who is giving birth to the most babies - with birthright citizenship children adding to the numbers – the arrival of a country where people of European ancestry [white] become a minority population, will occur more quickly than a lot of Americans on the political Far Right, would ever want to see happen.
It was actually on January 20th, of last year, Donald J. Trump issued Executive Order 14160, the purpose of which was to deny automatic citizenship to children in instances, where neither parent was a citizen, nor had yet to obtain status as a legal permanent resident.
Thus began the racially-charged battle about who deserves the right to be granted citizenship – and this time – a Supreme Court that is wildly unpopular and is held in low regard by the electorate, came down on the side of established law.
Donald Trump was out of line, and his own biased and corrupt Supreme Court that includes six conservative justices, bashed him right on the nose. The struggle over who gets to be called an American citizen and who does not, isn’t quite a dried ink situation, because old man Trumpy wants Congress to do something about this latest legal setback.
Good luck with that, because he’s losing the House, come this November.
But for now, those babies born on American soil, and regardless of the status of their parents, are citizens of United States of America.
That’s a win the goodhearted people of this country will surely take.
